1. Agreement
These Terms of Service (“Terms”) govern your use of the TruScan Systems website, partner portal, and related services — including the TruScan WhatsApp referral marketplace. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. About TruScan Systems
TruScan Systems (Pty) Ltd is a South African company operating a WhatsApp-powered referral marketplace for digital products. Our platform enables partners to earn commissions and milestone bonuses by sharing QR codes that direct customers to a curated catalogue of digital products sold entirely through WhatsApp. Merchants list their digital products on the TruScan marketplace and fulfil orders via WhatsApp-based automation flows.
3. Partner Programme
The TruScan Partner Programme allows approved individuals to earn income by sharing their unique QR code and driving product sales through WhatsApp. The programme is governed by the following terms:
Eligibility
Partners must be 18 years or older, a South African resident, and must be approved by TruScan before participating. TruScan reserves the right to approve or reject partner applications at its sole discretion.
QR Codes and Referral Tracking
Each approved partner is issued a unique QR code that links to the TruScan WhatsApp business number. Scans are tracked via the partner's referral ID. Partners may share their QR code digitally or in print. Partners may not misrepresent the nature of the QR code or use deceptive practices to generate scans.
Commissions
Partners earn a 10% commission on every confirmed sale that originates from their QR code. Commissions are credited to the partner's wallet automatically upon sale confirmation. TruScan reserves the right to reverse commissions on refunded or disputed transactions.
Big 5 Tier System & Milestone Bonuses
Partners progress through five tiers based on total QR scans, named after the animals on South Africa's bank notes. Reaching each tier unlocks a one-time cash bonus credited automatically to the partner wallet:
TruScan reserves the right to adjust tier thresholds and bonus values with reasonable notice.
Partner Wallet
Partner earnings (commissions and milestone bonuses) are managed via the TruScan WhatsApp wallet. Partners can check their balance and request payouts via WhatsApp. Payout terms, minimum thresholds, and processing timelines will be communicated through the partner WhatsApp channel. TruScan is not liable for delays caused by third-party payment processors.
Fraud Prevention
TruScan employs fraud detection including device fingerprinting, IP tracking, and scan pattern analysis. Fraudulent scan activity — including self-scanning, bot traffic, or coordinated manipulation — will result in forfeiture of all associated earnings and permanent account termination without prior notice.
4. Merchant Programme
Merchants are approved businesses or individuals who list digital products on the TruScan marketplace. By applying and being approved, merchants agree to the following:
Eligibility & Listing
TruScan currently accepts digital products only (eBooks, courses, templates, software, audio, design assets, coaching, and similar). Physical goods are not accepted at this time. All listings are subject to review and approval by TruScan. TruScan reserves the right to reject or remove listings at its discretion.
Commission & Fees
TruScan does not charge monthly listing fees. A platform commission (inclusive of the partner referral commission) is deducted from each sale. Commission rates are agreed upon during the merchant onboarding process and documented in the merchant agreement.
Fulfilment
Merchants are responsible for timely delivery of purchased digital products to customers via WhatsApp or email. TruScan's automation flows facilitate the transaction, but fulfilment responsibility rests with the merchant. Persistent fulfilment failures may result in delisting.
Prohibited Products
Merchants may not list products that are illegal, misleading, adult in nature, involve financial schemes, or violate any third-party intellectual property rights. TruScan may remove non-compliant listings and terminate merchant accounts without notice.
5. Acceptable Use
You agree not to: use our services for any unlawful purpose; attempt to manipulate or defraud the partner or merchant programme; interfere with the operation of our platform; impersonate another person or entity; attempt to gain unauthorised access to our systems; use automated tools to generate fraudulent scans or referrals; or post misleading, harmful, or prohibited content.
6. Intellectual Property
All content, software, designs, and systems created by TruScan remain the intellectual property of TruScan Systems (Pty) Ltd. Partner QR codes are issued under licence and remain the property of TruScan. Merchants retain ownership of their product content but grant TruScan a licence to display and distribute it through the marketplace.
7. Limitation of Liability
To the maximum extent permitted by South African law, TruScan Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services, including issues arising from WhatsApp platform availability, Meta API changes, or third-party payment delays. Our total liability shall not exceed the commissions or fees paid by or to you in the 12 months preceding the claim.
8. Privacy
Your privacy is important to us. Please refer to our Privacy Policy and POPIA Compliance page for details on how we collect, use, and protect your personal information.
9. Termination
TruScan may suspend or terminate your access to our services at any time for violation of these Terms. Partners and merchants may request account closure at any time by contacting our Information Officer via hello@truscan.co.za. Upon partner account termination, any unclaimed wallet balance will be reviewed and settled in accordance with our payout policy.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the revised Terms.
